Contract of public offer on charitable donation (assistance)
The following text of the Agreement, addressed to individuals and/or legal entities and is an official public offer (in accordance with Article 641 of the Civil Code of Ukraine) of the CHARITY FUND "Help Ukrainian People", represented by acting Head of the Management Board of Necheporenko Hanna Andriivna, acting on the basis of the Statute (hereinafter referred to as the Foundation), to conclude an agreement on a charitable donation (aid) under the following conditions: A public offer (offer) is understood as an opportunity, first of all, for individuals to make a charitable assistance (donation) through the Foundation by your will and desire.
1. Subject of the Agreement
Charitable aid (donation) means the free transfer by a person (benefactor) of funds to the property of the Foundation for further use and achievement of the Foundation's goals, defined by the Foundation's Statute or programs, in accordance with the Law of Ukraine "On Charitable Activities and Charitable Organizations", the Foundation's Statute and terms of this Offer.
By accepting the Offer (that is, accepting the Offer by taking actions, transferring funds), the person making the donation (the Benefactor) confirms that he agrees with all the terms of the Offer, understands and agrees with it.

2. Rights and obligations of the Benefactor
The benefactor undertakes:
- familiarize yourself with the Charter of the Charitable Organization;
- fulfill the requirements of this Agreement.
The benefactor has the right:
- monitor the use of charitable assistance (donations) by the Fund for its intended purpose, review reports on the provision of charitable assistance posted on the website and official pages.
3. Rights and obligations of the Fund
The Foundation undertakes:
- to use the charitable assistance received from the Benefactor in accordance with its intended purpose and in accordance with the requirements of the Charter, the terms of the Offer and the current legislation of Ukraine;
- upon request, submit a report to the Benefactor regarding the donation in the order, terms and form approved by the Foundation on the basis of the requirements of the current legislation of Ukraine.
- at the Benefactor's request, provide any statutory documents of the Charitable Organization. The Foundation has the right to use part of the charitable assistance for the administrative expenses of the Foundation in an amount not greater than that stipulated by the Law of Ukraine "On Charitable Activities and Charitable Organizations".
4. Charitable aid guarantees
The Foundation undertakes not to allow the donation to be used for a purpose other than that defined by this Offer and the statutory activities and programs of the Foundation. The fulfillment of the terms of this Offer is not intended for direct or indirect profit.
5. Term of Charitable Assistance
The receipt of charitable assistance (donations), funds owned by the Foundation for further use and achievement of the Foundation's goals, defined by the Statute or the Foundation's programs, continues until the termination of the Foundation's activities, unless otherwise determined by the decisions of its bodies. From the moment of acceptance of the Offer, this Agreement is concluded in writing in accordance with Articles 207, 639, 641 and 642 of the Civil Code of Ukraine and Articles 6 and 7 of the Law of Ukraine "On Charitable Activities and Charitable Organizations".
Consent-notification for the collection, processing and use of personal data
The benefactor, the person who accepted this Offer, of his own free will, voluntarily and without coercion confirms that in accordance with the provisions of the Law of Ukraine "On the Protection of Personal Data" he consents to the processing of his personal data by another Party (the Foundation) in order to ensure the implementation of economic relations, tax relationships and relationships in the field of accounting.
The person also confirms that he has been notified of the inclusion of his personal data in the personal data base of another Fund, that the actual amount of data transferred corresponds to the purposes of processing, and that the rights of the subject of personal data, which are defined by Article 8 of the Law of Ukraine "On the Protection personal data".
The Party to the Agreement that received the personal data of the representative of the other Party is obliged to ensure their protection against illegal processing and illegal access to them in accordance with the requirements of Article 24 of the Law of Ukraine "On the Protection of Personal Data" and other requirements stipulated by the current legislation of Ukraine.
This consent notice is valid for an indefinite period.
